Wenn die Darstellung eines Monopols und dessen Ausnutzung allein
für einen Gewinn des Prozeß durch die Regierungsseite nicht genügt,
ist die entscheidende Frage, wie sich Microsofts Stellung in den
von ihr besetzten Märkten bereits auf den Verbraucher ausgewirkt
hat oder langfristig auswirken wird. Für Anklage wie Verteidigung
ist es daher äußerst wichtig, welches Bild sie bei den Verbrauchern
selbst hervorrufen können. Das groß aufgezogene Kartellverfahren
ist vor allem ein Medienereignis, bei dem es darum geht, dem Zuschauer
und Konsumenten die glaubwürdigste Geschichte zu erzählen, die
packendsten Bilder zu liefern. Die Argumente wurden daher bereits
größtenteils im Vorfeld ausgetauscht, die Rollen in all ihrer
Vielfalt besetzt: Microsoft besteht auf dem Recht zur Innovation,
stellt sich als gehetzt von der Meute der Netscapes, Suns und
Yahoos dar und entschuldigt seine Business-Praktiken mit der "Tut
doch jeder"-Ausrede. Das Justizministerium sieht Microsoft dagegen
als Bulldozer, der die High-Tech-Ökonomie plattmacht. Few things matter more to the long-term economic health of the
U.S. than the correct outcome of this trial. Microsoft is at the
very heart of the high-tech economy that is driving growth and
prosperity in America. The legitimate issues raised by this power
must be resolved in ways that do not destroy the country's entrepreneurial
culture.. Microsoft accuses Washington of putting Silicon Valley's
way of life on trial.. Monopoly is the issue, not culture and
the behavior that goes with it. Properly conceived, the role of our antitrust laws is to maximize
consumer welfare allowing the marketplace to work its will so
that the products consumers want can be produced in an efficient
fashion and offered at competitive prices. With the wall-to-wall coverage of the Microsoft antitrust trial,
the bewildered public gets the detailed info needed to make some
sense of the complex proceeding. But there's also a point of overload,
with so many talking heads, bizarre angles and tangled lingo leading
inevitably to frustration. Der kartellrechtliche Aspekt erscheint nur vordergründig.. "Es
ist ein bißchen wie mit Clinton", kommentiert der Washingtoner
Unternehmensberater Steven Mills den Prozeß. "Jeder weiß, daß
er etwas falsch gemacht hat. Doch wer mit dem Ergebnis zufrieden
ist, will auch Bill Gates nicht an den Pranger stellen." U.S. v. Microsoft has been an entertainment bonanza for those
who get off on seeing the wealthy and powerful get knocked around
(and who doesn't?). The giggle factor almost, but not quite, makes
us forget that this trial had been billes as something more substantial:
a showdown that would help determine the ground rules for antitrust
law in the high-tech 21st century. Public opinion, to be sure, plays no direct role in antitrust
policy. Yet it is inevitably a consideration when bringing a major
case like the suit against Microsoft. Congress controls the Justice
Department's budget, and a big case that is seen as too far out
of step with public opinion could bring pressure from Congress..
"Part of that exercise is to convince people that what the Government
is doing is in the interest of the consumer," noted Robert Litan,
a former senior official in the Justice Department's antitrust
division. The more we see the of the case, the more clear it is that there's
an effort here to advance the interests of a handful of competitors
over the interests of the public and the economy.
Im Mittelpunkt des Verfahrens: Der Verbraucher und die Medien
Neue Einsichten und "Einlagen" entnehmen beide Seiten vor allem
"internen Emails", also dem eigentlich "flüchtigsten" Medium des
Informationszeitalters. Abgefragt wird die Meinung des Verbrauchers
gleichzeitig durch aktuelle Umfragen. Aus dem "Jahrhundertprozeß"
um die Zukunft der amerikanischen Wirtschaft -- dem "Glaubenskrieg
der Computerindustrie" (Business Week) -- und das Kartellrecht
im 21. Jahrhundert wird so ein Medienspektakel mit hohem Unterhaltungswert.
